Papayyya operates as a platform that connects users with service providers ("Partners"). We are not a party to any agreement between you and a Partner. We facilitate transactions but are not responsible for the quality, delivery, or outcomes of services provided by Partners.
Partners are independent contractors, not employees of Papayyya. We do not control, direct, or supervise Partners' work. Partners are solely responsible for the quality and delivery of their services.
When using our marketplace, you are responsible for clearly defining your requirements, communicating effectively with Partners, and making payment for services rendered. You agree to treat Partners with respect and professionalism.
In the event of a dispute between you and a Partner, we may facilitate resolution but are not obligated to do so. Our decision in any dispute is final and binding, subject to applicable law.
The Service, including all content, features, functionality, and technology, is owned by Papayyya and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our express written permission.
You retain ownership of any content you create, upload, or share through our Service. By using our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing and improving our Service.
Partners retain ownership of their work unless otherwise agreed upon. When you engage a Partner through our marketplace, you may obtain rights to their work as specified in your agreement with the Partner.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee any specific results from using our Service, including AI-generated plans or marketplace services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPAYYYA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
You agree to indemnify, defend, and hold harmless Papayyya, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another.
Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 30 days of your notice.
If we cannot resolve a dispute informally, you agree that any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration organization, rather than in court.
You agree that disputes will be resolved individually and not as part of a class action or representative proceeding.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. For users in other jurisdictions, local laws may apply as required by applicable law.
